12. Yangshan Deepwater Port, Bonded Port

12.2 Policies of the Bonded Port

12.2.1 Basic Conditions

Yangshan Port Bonded Area came into operation together with Yangshan Deepwater Port after the State Council approved its establishment.

Yangshan Port Bonded Area is composed of Dayangshan Port Area, Luchaogang land Area and the East Sea Bridge linking Xiaoyangshan Island with the coast. The planned area is 8.14 sq. km., and the operation of first phase of the Bonded Area covers an area of 7.2 Sq.km.. It is the first Port Bonded Area in our country and also an operation mode innovation area combining the functions of the port, bonded area, export processing zone and bonded logistic park.

Xiaoyangshan Port Area of the Port Bonded Area is also an operation area of the container deepwater port with a bonded area of 2.14 sq.km..

The land area of the Bonded Port is close to the main city area of Lingang New City and Lingang Heavy Equipment Industrial Area, with an area of 5 sq.km. within the customs boundary at present. The plan mainly covers the development and construction of an inspection area, a port auxiliary area, a warehousing and distribution area, an FCL, LCL and transfer area, a processing and manufacturing area, and commercial and trade demonstration area to gradually provide industrial and service functions of container port appreciation, import and export trade, processing and manufacturing, bonded logistics, procurement and distribution, shipping services, etc.. Around the area there will be a Lingang non-bonded logistic park, a railway central marshalling yard, container river transfer area, dangerous goods storage area, and other logistic operation areas.

12.2.2 Maximum Policy Incentives

Yangshan Port Bonded Area has the basic functions of a container hub port, and in addition to that, all the policies in respect of customs, inspection and quarantine, foreign exchanges, tax, etc. currently applicable in bonded areas, export processing areas and bonded logistic parks are applicable in the Port Bonded Area. The 3 in 1 Policies mainly include exemption from customs duties on imported goods which have arrived in the port area; refund of VAT on domestic goods which have arrived in the port area as if they had been exported; no VAT or consumer taxes on goods transactions between enterprises within the port area; relatively relaxed foreign exchanges administration; and quick and convenient port customs clearance procedures.

The 3 in 1 Policies have made the Port Bonded Area an area Closest to the international practice followed in special economic zones in terms of preferences, opening and convenience. This is reflected in the following:

Having the functions of the port. The supervision over and administration of the Port Bonded Area is exercised by Yangshan Customs Office alone. The inconvenience usually caused in supervision and administration procedures and increased logistic links by the supervision over and administration of containerized goods arriving at or leaving the Bonded Area and Bonded Logistic Park by two customs offices of the Port Customs Office and Bonded Area Customs Office as a result of the separation of the port city and the bonded area and the separation of the port and the bonded area has been obviated, and the customs clearance of containerized goods is more efficient.

Expanded Business Scope. Yangshan Port Bonded Area may do many kinds of businesses of loading and unloading of containers, LCL service, transfer, warehousing and logistics, processing and manufacturing with strengthened regional comprehensive functions. The restrictions on business operations of enterprises in the Bonded Area by the single function of the Bonded Logistic Park or Export Processing Zone has been prevented, attracting procurement centers, distribution centers, marketing centers, R & D centers and other comprehensive and complementary enterprises in the industrial chains to the Port Bonded Area..

Refund of VAT on domestic goods entering in the Port Bonded Area. VAT may be refunded once the related export goods or materials and parts to be processed in the Port Bonded Area arrive in the Port Bonded Area, thus greatly simplifying the refunding procedures and shortening the time for the procedure.

Yangshan Deepwater Port and Yangshan Port Bonded Area depend on each other and are complementary to each other, greatly improving the shipping infrastructure and remarkably strengthening the function of concentration and radiation and international transfer of Shanghai as an international shipping center.

12.2.3 Direction of the Industrial Development

The key industries and functions to be developed in Yangshan Port Bonded Area are in the following ten aspects:

(1) Container loading and unloading, and transportation. Qualified enterprises may conduct businesses of international shipping, international shipping agency, international shipping management, international marine cargo loading and unloading, international marine cargo storage, non-vessel owing common carrier, and shipping container storage yard.

(2) Container port appreciation business. The enterprises in the Port Bonded Area, which have obtained permission from the competent authorities, may conduct container loading and unloading, stacking, transfer, LCL transfer, FCL transfer, container transportation and multi-modal combined transportation, and provide port facilities, equipment, port machinery leasing and repair services.

(3) Procurement and Distribution. The enterprises in the Port Bonded Area may establish international procurement centers, logistic distribution centers and allocation centers, and conduct internal and external commodity procurement, goods international allocation, freight transport, logistic distribution, etc.. The development of international logistic operation centers by the enterprises in the Port Bonded Area will be encouraged.

(4)Storage and Commercial Processing. The enterprises in the Port Bonded Area may engage the investment in and construction and leasing of warehouse facilities in the Port Bonded Area, and in bonded storage of commodities. The storage and transaction of internal and external futures will be encouraged. The enterprises may engage in commercial processing of the goods stored in the Port Bonded Area, and the processing may include classification, packaging, selection, categorization, labeling, parceling out, mark printing, logo printing, etc..

(5) Trade. The enterprises in the Port Bonded Area may freely engage in the trade between the Port Bonded Area and an external party and within the Port Bonded Area itself, and transit trade will be encouraged.

(6) Shows and Fairs. The enterprises in the Port Bonded Area may set up commodity exchange markets and retail centers, hold commodity shows, engage in shows, exhibitions and fairs of external commodities and commodities of non-port bonded areas, and in related consulting and agency services, technical training and logistic services. The development of the business of international transaction centers of commodities of large quantities will be encouraged.

(7) Processing and Manufacturing. The enterprises in the Port Bonded Area may engage in Processing and Manufacturing, reproduction, bonded maintenance and repair, inspection and testing, and product R & D center businesses. The Port Bonded Area will focus on introducing from outside and developing the processing and manufacturing projects of machinery and electric products, instruments, IT products, car parts and components, fine chemicals, high grade consumer goods, etc.. The enterprises in the Port Bonded Area may, under the relevant provisions of the customs office and with prior approval, entrust the enterprises outside the Port Bonded Area with the processing of the materials imported from abroad, or accept processing business entrusted by the enterprises outside the Port Bonded Area.

(8) Finance. Domestic or Foreign financial institutions may establish branches in the Port Bonded Area to operate related financial services. Foreign -invested banks in the Port Bonded Area can,with approval, operate RMB businesses. Chinese and foreign financial institutions in the Port Bonded Area may, with approval, operate off-shore finance, external financing, external guarantee and other specially permitted businesses. The development of financing business of logistic banks by financial institutions in the Port Bonded Area will be encouraged.

(9) Innovation and development of scientific and technical products. Enterprises will be encouraged to engage in product and technical research and development, data processing, software development and other businesses, and develop projects of self-initiated innovations and hi-tech pioneering work.

(10) Shipping and logistic services. Enterprises will be encouraged to engage in shipping and logistic services of customs declaration, inspection application, freight agency, shipping agency, tallying, shipping insurance, boat insurance and other services such as equipment leasing, etc. in the Port Bonded Area.

12.2.4 Service Measures

The Port Bonded Area Administration Commission has been established to take charge of the administration of routine affairs of the Port Bonded Area on behalf of the government, and coordinate matters in the implementation of related policies of the Port Bonded Area. The authorities of customs, exit and entry inspection and quarantine, port, border security, public security, etc. have set up their branches in the Port Bonded Area, corresponding offices and windows are open for normal service, and measures have been taken to optimize their services. A tax sub-bureau has been stationed there, and the setting up of offices of the administrations of commerce and industry and foreign exchanges is in preparation.

Since May 10, 2005, the loading and unloading fee for coastal and international-transfer container vessels at Yangshan Deepwater Port has been lowered by 20%, the loading and unloading fee for Yangtze River-transfer container vessels lowered by 50%, no shuttle bus loading and unloading fee is charged for international-transfer containers, and the ships anchoring at both Waigaoqiao and Yangshan are charged only once for shifting, piloting and towing. These four measures will cut the cost of shippers by 30%.
